2. Scope of services

HIKU provides climbing coaching and performance guidance including:

  • Online coaching programs

  • Remote training plans

  • Zoom check-ins

  • WhatsApp support

  • Personalized assessments

  • In-person coaching sessions at Boulderzaal The Island, Antwerp (Granite Plan)

  • Training documentation and progress tracking

All services are tailored to the client’s skill level and physical condition but do not replace professional medical advice or physiotherapy.


3. Eligibility

By purchasing or participating in HIKU services you confirm that:

  • You are 18 years or older (or have parental consent).

  • You are physically fit to participate in climbing activities.

  • You have no medical conditions that would prevent safe participation unless cleared by a medical professional.

Participation is always at your own responsibility.


4. Safety & risk disclaimer

Climbing and training inherently carry risk of injury. HIKU does not assume responsibility for injuries or damages resulting from:

  • Misuse of climbing equipment

  • Failure to follow instructions or training protocols

  • Accidents occurring in gyms or training facilities

  • Health conditions unknown to the coach

Clients participate fully at their own risk.


5. Payments & subscriptions

Payment

All programs must be paid in advance via the website or otherwise agreed payment method.

Subscriptions

  • Subscriptions start immediately upon purchase.

  • Recurring payments are billed automatically.

  • Pricing is listed clearly on the website.


6. Cancellation policy

Online coaching subscriptions

  • Monthly subscriptions may be cancelled anytime.

  • Cancellation must be submitted at least 7 days before the next billing date.

  • If cancellation is late, the next month will still be charged.

In-person sessions

  • Sessions may be rescheduled or cancelled up to 24 hours prior to the appointment.

  • Cancellations made less than 24 hours in advance are non-refundable and considered used sessions.

No refunds are provided for missed or unused sessions.


7. Refund & return policy

Because services are customized and begin immediately, HIKU applies the following refund rules:

Digital coaching products

  • No refunds after program access or delivery has started.

  • This includes training plans, assessments, and online coaching sessions.

Subscription refunds

  • Subscription payments already processed are non-refundable.

Exceptional circumstances

Refunds may be considered only in cases of:

  • Severe health issues preventing participation (medical proof required), or

  • Service non-delivery from HIKU’s side.

Refund decisions are entirely at HIKU’s discretion.


8. Results disclaimer

HIKU does not guarantee:

  • Specific climbing grades

  • Competition outcomes

  • Physical performance or aesthetic results

Results depend on:

  • Client commitment

  • Training consistency

  • Physical condition

  • Lifestyle outside coaching

HIKU provides guidance and expertise — performance improvements are the client’s responsibility to execute.


9. Liability limitation

To the maximum extent permitted by law, HIKU is not liable for:

  • Any physical injury or health damage

  • Loss of income or business opportunities

  • Emotional distress or performance dissatisfaction

  • Property damage during training or travel

Liability is limited to the amount paid by the client for services received in the previous month only.


10. Intellectual property

All training materials, plans, media, documents, and systems provided by HIKU are:

  • Protected by copyright

  • For personal client use only

Clients may not:

  • Resell

  • Redistribute

  • Copy or share materials publicly


11. Client conduct

HIKU maintains a professional training environment. Coaching may be suspended or terminated without refund if a client:

  • Behaves abusively toward staff or other participants

  • Disregards safety protocols

  • Acts unlawfully or disruptively

  • Fails to follow ethical or respectful conduct


12. Privacy & data

Personal client data is used solely for:

  • Coaching administration

  • Training personalization

  • Payment processing

Data is handled in accordance with GDPR regulations and never sold to third parties.


13. Force majeure

HIKU is not responsible for service interruptions caused by:

  • Illness or injury of coaches

  • Natural disasters

  • Government restrictions

  • Facility closures

  • Unforeseen technical outages

Sessions lost due to force majeure are not refundable, but best efforts will be made to reschedule where reasonable.


14. Governing law

These Terms are governed solely by Dutch law.

All disputes are handled in the jurisdiction of The Netherlands, district court of Rotterdam.
